REFERRAL AGREEMENT

This agreement (the “Agreement”) establishes a referral arrangement between BuildBidz™ ( Legal entity Name- 3JAY Innovations Labs pvt ltd (“3JAY”) and you (the “Partner”), effective when accepted by you. This Agreement hereby incorporates 3JAY Innovations Labs’s Additional Referral Terms and Conditions located at https://www.buildbidz.in/terms 

Background: BuildBidz™ connects residential or commercial construction customers (“Project Owners”) seeking a remodeling, design, or construction service (“Project”) with a qualified Partner. After a Project Owner engages BuildBidz™ for the support on a Project (“Service Request”), BuildBidz may recommend Service Provider to the Project Owner (“Referral”) by sourcing multiple bids from only Service providers on the Platform. A Project is awarded (“Award”) at the sole discretion of the project owner and it results in an executed contract or other agreement between the Project Owner (or their affiliates) and Partner.

Referral Terms

• Upon receiving a shortlisting (pre-award) notification, Partner agrees to pay a referral fee to BuildBidz™- 3JAY Innovations Labs (“Referral Fee”) of Flat 2% of the overall Project Value.
• The Referral Fee is a percentage of Project’s total value (including labor and material costs in      construction).
• BuildBidz™ Platinum Partners shall only be eligible to pay Referral Fee Only after the successful Award of the Project, during the contract agreement SignOff. 
• All Partners, Other than Platinum partners, will be agreeing to deposit Referral Fee during the shortlisting stage. The same referral fee shall be refunded, if failed to close the deal. In case of successful deal, such deposited referral fee shall be adjusted to final deal close value.
• Partners should not by-pass BuildBidz and engage with Project Owner (Partner’s existing or New) directly to avoid Referral Fee payment. In which BuildBidz may blacklist the partner permanently, and may initiate necessary legal action.
• Providers will maintain all applicable licenses in good standing and follow all applicable laws.
• The relationship between Service Provider and BuildBidz™- 3JAY Innovations Labs is that of independent contractors. No employment, partnership or joint venture relationship is formed by the Agreement.
